Uttarakhand High Court dismisses PIL against company not returning money collected from investors

The Uttarakhand High Court dismissed a Public Interest Litigation (PIL) filed with the grievance that the opposite party/ /company has collected money from several investors and are not returning the same.

The PIL initiated at the behest of the some elected representatives like Member of Zila Panchayat etc , therefore, has prayed to issue a direction to submit the entire records related to the accounts of investors in the entire State of Uttarakhand before the High Court and direct the opposite party/ /company and its subsidiary societies to start the repayment of money of the investors.

While considering the PIL , the Division Bench of Acting Chief Justice S.K. Mishra and Justice R.C. Khulbe noted from the record that though the petitioner said that he has received several complaints from different individuals of Pithoragarh and Almora but not a single complaint has been filed in the Petition.

Moreover, the Court observedd that the document that has been prepared by the petitioner are all self serving documents being prepared in hand on a paper and not a single copy of the receipt has been filed in the PIL to show that actually opposite party/ /company has received money from any of the respondent of Pithoragarh and Almora for the purpose of creating saving deposit or any other financial purpose.

In that view of the matter, the Court is of the opinion that this is a speculative PIL and there is no merit in the same and therefore the High Court dismissed the PIL.
